1. About this Privacy Notice

Aperio ("Aperio", "we", "us" or "our") respects your privacy and is committed to protecting your personal information.

This Privacy Notice explains how we collect, use, store and protect personal information when you interact with Aperio, including when you:

  • submit information or artworks to Aperio;
  • purchase or enquire about an artwork;
  • provide billing or delivery information;
  • request delivery assistance, cancellation, return or refund;
  • report a damaged, faulty, incomplete or misdescribed artwork;
  • apply to an open call or exhibition;
  • are selected, invited or represented by Aperio;
  • communicate with us by email, through our website or through an online form;
  • subscribe to receive communications from us; or
  • otherwise provide personal information to Aperio.

We process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 ("GDPR"), the Data Protection Act 2018 and other applicable data protection legislation.

2. Who is responsible for your personal information?

3. What personal information do we collect?

The information we collect will depend upon your relationship and interactions with Aperio.

Collector and purchaser information

When you enquire about or purchase an artwork, we may collect:

  • your name, email address and telephone number;
  • billing and delivery addresses;
  • order details and purchase history;
  • payment status and transaction references, although payment providers generally process complete payment-card details;
  • delivery instructions, tracking information and proof of delivery;
  • correspondence concerning enquiries, orders and customer service;
  • cancellation, return and refund information;
  • photographs and other evidence supplied in connection with damage, condition or non-conformity claims; and
  • customs, tax or identity information where reasonably required for delivery, fraud prevention or legal compliance.

Where you create a customer account through the Aperio website, we may collect or process information associated with that account, including your login credentials, account preferences and settings.

Artist information

When an artist submits work to Aperio or works with the gallery, we may collect information including:

  • full name and professional/artist name;
  • email address;
  • telephone number;
  • postal address and country of residence;
  • website and social media details;
  • artist biography and artist statement;
  • CV, exhibition history, awards, publications and other professional information;
  • photographs or portraits supplied by the artist;
  • information concerning artworks, including titles, dates, media, dimensions, editions, prices, availability and provenance;
  • images and digital files of artworks;
  • information relating to the ownership, copyright and authenticity of artworks;
  • exhibition and representation information;
  • correspondence between you and Aperio;
  • payment, invoicing and transaction information where required; and
  • any other information you choose to provide to us.

Please do not provide sensitive or special-category personal information unless it is specifically requested and necessary for a particular purpose.

Website and communications information

When you visit our website or communicate with us, certain technical information may also be collected, such as:

  • IP address;
  • browser and device information;
  • website usage information, including pages and artworks viewed and, where applicable, items placed in a shopping cart or otherwise interacted with;
  • cookie and analytics information; and
  • records of communications with Aperio.

Cookies and similar technologies

Aperio uses cookies, pixels and similar technologies to operate the website, remember preferences, understand how visitors use the website and measure advertising. Some cookies are required for functions such as security, the shopping cart, checkout and payments. We also use Shopify, Google Analytics, Google Ads, Meta Pixel and Mailchimp, which may collect information including your IP address, device and browser details, identifiers, pages or artworks viewed, referring sources and interactions with the website. Where enabled and permitted by applicable law, information collected through marketing technologies may be used to measure advertising effectiveness and to provide advertising based on interactions with Aperio or other online services.

Where consent is required, optional analytics, personalisation and marketing technologies are used only after you consent through our Cookie and privacy preferences tool. You may accept or decline optional categories and change or withdraw your choices at any time by reopening that tool. Required cookies cannot be disabled through the tool because the website may not function properly without them.

The particular cookies used and their duration may change when our service providers update their technologies. Further information is available in the privacy and cookie notices of Shopify, Google, Meta and Mailchimp.

4. How we use your personal information

We may process personal information for the following purposes:

Purchases, delivery, returns and customer service

We may use collector and purchaser information to:

  • respond to artwork and purchase enquiries;
  • process and administer orders and payments;
  • confirm artwork availability;
  • provide the dispatching artist and carrier with the information necessary to deliver an order;
  • provide tracking and delivery updates;
  • administer cancellations, returns, refunds and complaints;
  • investigate damaged, lost, faulty or misdescribed artworks;
  • support carrier and insurance claims;
  • administer customs and international delivery requirements;
  • prevent fraud and misuse; and
  • maintain appropriate transaction, accounting and provenance records.

Artist submissions and selection

We use information submitted by artists to:

  • receive and administer artist submissions;
  • assess artworks and artist practices for representation, exhibitions, open calls or other opportunities;
  • communicate with artists about their submissions;
  • conduct curatorial selection and review; and
  • maintain appropriate records of submissions and selections.

Gallery representation and exhibitions

Where an artist works with or is represented by Aperio, we may use personal information to:

  • administer the professional relationship between Aperio and the artist;
  • catalogue and manage artworks;
  • prepare artwork listings;
  • organise exhibitions and curatorial projects;
  • communicate with collectors and potential purchasers about artworks;
  • administer enquiries, reservations and sales;
  • maintain records relating to provenance, authenticity, editions and sales;
  • prepare Certificates of Authenticity or associated documentation where appropriate; and
  • fulfil our contractual obligations to artists and purchasers.

Promotion of artists and artworks

Where appropriate, we may publish or distribute professional information supplied by artists, including:

  • artist names;
  • biographies;
  • artist statements;
  • CV and exhibition information;
  • artwork information;
  • images of artworks;
  • artist portraits;
  • interviews and editorial material; and
  • links to artist websites or professional social media accounts.

This information may appear on the Aperio website, online exhibitions, social media, press material, newsletters, catalogues, promotional material and other communications connected with the promotion of Aperio, its artists and exhibitions.

Business administration

We may process personal information where necessary for:

  • accounting and financial administration;
  • maintaining transaction and sales records;
  • responding to enquiries;
  • managing contracts and agreements;
  • protecting the legal rights of Aperio, its artists and customers;
  • preventing fraud or misuse of our services; and
  • complying with legal, regulatory, accounting or tax obligations.

5. Our lawful bases for processing

Under GDPR, Aperio must have a lawful basis for processing personal information.

Depending upon the circumstances, we may rely upon one or more of the following:

Performance of a contract

We may process information where necessary to enter into or perform an agreement with you, including administering artist representation, exhibitions, artwork listings, purchases, payments, delivery, cancellations, returns and refunds.

Steps taken before entering into a contract

Where an artist submits work for consideration, we may need to process the information supplied in order to assess a potential professional or contractual relationship.

Legitimate interests

We may process personal information where necessary for the legitimate interests of Aperio, provided those interests are not overridden by your rights and interests.

These legitimate interests may include:

  • operating and administering a professional art gallery;
  • reviewing and curating artist submissions;
  • maintaining professional relationships with artists;
  • promoting artists and artworks represented or exhibited by Aperio;
  • responding to enquiries;
  • maintaining appropriate business records; and
  • protecting the integrity and security of our business and services.

Legal obligations

We may process and retain certain information where required to comply with legal, regulatory, accounting or taxation requirements.

Consent

Where we rely specifically upon your consent, for example for certain direct marketing communications, you may withdraw that consent at any time.

Withdrawal of consent does not affect the lawfulness of processing carried out before consent was withdrawn.

Where required, we rely on your consent to use non-essential analytics, personalisation and marketing cookies and similar technologies.

6. Artist submissions through online forms

Aperio may use third-party form services, including Jotform, to collect artist submissions and related information.

Information submitted through these forms is processed on behalf of Aperio for the purposes described in this Privacy Notice.

Artists should only provide information requested by the form and should avoid including unnecessary personal or sensitive information in artist statements, biographies, CVs or other uploaded documents.

7. Who may have access to your information?

Personal information will only be made available where reasonably necessary for the purposes for which it was collected.

This may include access by:

  • authorised personnel working for or on behalf of Aperio;
  • curators or professional advisers engaged in connection with an exhibition or selection;
  • website, e-commerce, hosting and information-technology service providers;
  • online form and data-storage providers;
  • payment and financial service providers;
  • accountants and professional advisers;
  • delivery, logistics or artwork-handling providers where necessary;
  • the artist responsible for supplying or dispatching an artwork, where necessary to fulfil an order;
  • carriers selected by Aperio or the artist;
  • insurers and claims-management providers where necessary to investigate loss or damage; and
  • customs authorities, customs brokers and international delivery agents where required.
  • marketing, mailing and communications providers; and
  • public authorities where disclosure is required by law.

Where buyer information is provided to an artist for order fulfilment, the artist is contractually required to use it only as necessary to administer and deliver that order, to keep it secure and not to use it for independent marketing. The artist may provide necessary delivery information to the selected carrier or insurer.

Third-party service providers processing personal information on our behalf are required to handle that information appropriately and in accordance with applicable data-protection requirements.

We do not sell personal information to third parties.

Shopify

The Aperio website and online store are hosted by Shopify. Shopify processes certain personal information when you access or use the website, including information necessary to provide the e-commerce services used by Aperio.

Information submitted through the website may therefore be transmitted to and processed by Shopify and its service providers. Shopify may also process information relating to your interactions with the Aperio website in accordance with its own privacy policies and, where applicable, to provide Shopify services and enhanced features.

8. Public information about artists

Artists should be aware that certain information is supplied to Aperio specifically for public presentation and promotion.

Where an artist is selected for an exhibition, open call, curatorial selection or gallery representation, information such as the artist's name, biography, professional background, artwork details and artwork images may be published publicly.

Once information has legitimately been published online, it may also be indexed by search engines, referenced by third-party websites or shared through social media. Aperio cannot completely control copies or references made by independent third parties after lawful publication.

We will not publish private contact information such as your personal email address, telephone number or home address unless you have expressly agreed to this or there is another appropriate reason for doing so.

9. Third-party websites

The Aperio website may contain links to websites, social media platforms or services operated by third parties. Their collection and use of personal information is governed by their own privacy policies. Aperio is not responsible for the privacy practices of independent third-party websites or services.

10. International transfers

Some artists, carriers, insurers and technology or service providers used in connection with an order may be located outside Ireland or the European Economic Area (“EEA”), or may process or provide access to personal information outside the EEA.

Where personal information is transferred outside the EEA, Aperio will take appropriate steps to ensure that the transfer is made in accordance with applicable data-protection law and that appropriate safeguards are in place where required.

These safeguards may include an adequacy decision of the European Commission, Standard Contractual Clauses approved by the European Commission, or another lawful transfer mechanism provided for under GDPR.

11. Children's personal information

Aperio's website and services are not directed at children and we do not knowingly collect personal information from children except where there is an appropriate lawful basis to do so. If you believe that a child has provided personal information to Aperio inappropriately, please contact us.

12. How long we keep personal information

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including legal, accounting, contractual and legitimate business requirements.

Retention periods will depend upon the nature of the information and your relationship with Aperio.

For example:

  • information relating to unsuccessful or unselected submissions may be retained for a reasonable period following completion of the relevant selection or open call;
  • information relating to represented or exhibited artists may be retained for the duration of the professional relationship and for an appropriate period afterwards;
  • artwork, exhibition, provenance and sales records may be retained for longer periods because of their historical, contractual, authenticity or legitimate record-keeping value;
  • order, delivery, return, refund, complaint and payment records may be retained for the periods reasonably required for contractual, accounting, taxation, fraud-prevention and legal purposes; and
  • financial and transaction records will be retained for the periods required under applicable accounting and taxation law.

Where information is no longer required, it will be securely deleted, anonymised or otherwise disposed of as appropriate.

13. Security of personal information

Aperio takes reasonable technical and organisational measures to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access.

Access to personal information is limited to persons and service providers who reasonably require it for legitimate business purposes.

No method of electronic transmission or storage can, however, be guaranteed to be completely secure.

14. Your data protection rights

Subject to the circumstances and applicable law, you may have the right to:

  • access personal information held about you;
  • correct inaccurate or incomplete personal information;
  • request the deletion of your personal information;
  • request the restriction of certain processing;
  • object to processing based upon legitimate interests;
  • receive certain personal information in a portable format;
  • withdraw consent where processing is based upon consent; and
  • lodge a complaint with a data-protection supervisory authority.

These rights are not absolute and may be subject to legal exceptions. For example, Aperio may be required to retain certain transaction, contractual or financial information even where deletion has been requested.

16. Direct marketing

Where you have subscribed to receive marketing communications from Aperio, we may use your contact information to send you information about exhibitions, artists, open calls, events, gallery news and related activities.

You can unsubscribe from marketing communications at any time by using the unsubscribe facility provided in the communication or by contacting Aperio.

Choosing not to receive marketing communications will not affect necessary communications relating to an existing submission, exhibition, artist relationship, transaction or agreement with Aperio.

17. Changes to this Privacy Notice

We may update this Privacy Notice periodically to reflect changes in our activities, technology, service providers or legal obligations.

The current version will be published on the Aperio website and the date of the latest revision will appear at the top of this notice.
