Please read these terms before placing an order. They explain who you are buying from, how orders and delivery work, and your rights if you cancel an order or an artwork arrives damaged or faulty.

1. About Aperio

Aperio ("Aperio", "we", "us" or "our") is an online art gallery registered in Ireland.

Aperio is the seller under your contract. An artist may package and dispatch an artwork directly to you on our behalf, but Aperio remains your point of contact for the order, delivery, cancellation, return, refund or complaint.

2. Scope of these terms

These Terms of Sale apply to purchases of original artworks, limited-edition prints and other art products offered through aperiogallery.com. They apply to consumers purchasing mainly for personal use. If you purchase wholly or mainly for business purposes, please contact us before ordering because different terms may apply.

Our Shipping Policy and Returns Policy form part of these Terms of Sale and provide additional information about delivery, cancellation and returns. If either policy conflicts with these Terms of Sale, these Terms of Sale will take priority, except where the policy gives you an additional right or protection.

Our Privacy Policy explains how we use personal data. Separate Website Terms may govern your general use of the website. If these Terms of Sale conflict with information on an artwork page about the artwork itself, the artwork page and your order confirmation take priority for that artwork, except where doing so would reduce a mandatory consumer right.

3. The artworks

We take reasonable care to ensure that descriptions, images, dimensions, materials, edition details, framing information, condition notes and prices are accurate. Please read the full artwork page before ordering.

Original and handmade works may contain variations, surface texture, irregularities or signs of the artist’s methods. These are not defects where they form part of the work as described. Dimensions may vary slightly where measurements are approximate.

Screen settings, lighting and photography can affect colour. We cannot guarantee that your screen displays colour exactly, but the artwork must still correspond with its description and images to the standard required by law.

Unless expressly stated, a frame or installation hardware shown in a room mock-up is illustrative and is not included. The product page will state when framing or other accessories are included.

4. Availability and placing an order

Artworks are subject to availability. Because artists may exhibit or offer works elsewhere, an artwork may occasionally become unavailable before our website is updated.

When you place an order, you make an offer to purchase the artwork. An automated acknowledgement confirms that we have received your order but does not mean that we have accepted it.

A binding contract is formed when we send an order confirmation stating that your order has been accepted. Once the order has been accepted, we will take payment using the payment method authorised at checkout.

Before accepting an order, we may decline it if the artwork is unavailable, the price or description contains an obvious error, payment cannot be authorised, delivery is not possible to the address supplied, or we reasonably suspect fraud or unlawful activity.

After accepting an order, we may cancel it before dispatch where we discover that the artwork is unavailable, cannot legally or safely be delivered, or was listed with an obvious and material pricing or description error. If we cancel an accepted order, we will refund any payment promptly using the original payment method.

5. Price and payment

The price shown at checkout is the price payable for the artwork and includes standard shipping to the selected destination unless the checkout clearly states otherwise. Any applicable Irish VAT will be included where required.

For deliveries outside the European Union, the buyer is responsible for import VAT, customs duty, clearance charges and any other charges imposed by the destination country. These charges are not controlled by Aperio.

Payment is taken through the payment methods shown at checkout. You confirm that you are authorised to use the payment method and that the billing and delivery information supplied is complete and accurate.

Promotional codes and discounts are subject to their stated conditions, cannot be exchanged for cash and cannot be combined unless we expressly allow it. We may refuse an order that relies on an obvious pricing or discount error.

6. Delivery

The artwork may be dispatched directly by the artist or by another fulfilment provider acting for Aperio. Your order confirmation or dispatch email will provide the available delivery information and tracking details.

We aim to dispatch each artwork within the period stated on its product page or in the order confirmation. If no delivery period has been agreed, we will deliver without undue delay and no later than 30 days after the contract is formed, unless you agree to a later date.

You must provide a complete and accurate delivery address and any information reasonably required by the carrier. If delivery fails because the information supplied was incorrect, no one was available to accept a delivery that required attendance, or you fail or refuse to pay applicable import charges, we may charge you the reasonable cost of returning or redelivering the artwork after telling you what that cost will be.

If delivery is delayed, contact Aperio. Your legal remedies for late or failed delivery are not affected by any estimated date or by the use of a third-party carrier.

7. Risk and ownership

The risk of loss or damage passes to you when you, or a person you nominate other than the carrier, takes physical possession of the artwork. Ownership passes to you once we have received payment in full and the artwork has been delivered.

8. Inspecting delivery and reporting damage

Please inspect the outer packaging before accepting delivery where practicable. Photograph any visible damage to the packaging before opening it, retain the packaging, and photograph the artwork and all packaging as you unpack it.

Contact Aperio as soon as possible if an artwork arrives damaged, defective, incomplete or different from its description. Where reasonably possible, provide photographs of the artwork, shipping labels and packaging and retain all packaging until we have provided instructions. This evidence assists with assessing the claim and pursuing the carrier or insurer, but an inability to provide photographs or a delay in notifying us does not by itself remove any statutory rights you have.

Do not return a damaged artwork without contacting us first. We will provide return instructions. Where a return is required because the artwork arrived faulty or damaged, Aperio will arrange an appropriately insured return or collection at no cost to you.

9. Your 14-day right to cancel

If you are a consumer in Ireland, the European Union or another country whose mandatory law gives an equivalent right, you may cancel most online purchases without giving a reason within 14 days after you, or a person you nominate other than the carrier, receives the artwork.

To cancel, send us a clear statement by email or post before the 14-day period ends. You may use the model cancellation form at the end of these terms, but you do not have to.

After notifying us, you must return the artwork within a further 14 days, following the return instructions we provide. You are responsible for arranging and paying for appropriately insured and tracked return delivery when you cancel simply because you changed your mind.

You may inspect the artwork only as you reasonably would in a gallery or shop. You may be responsible for any reduction in value caused by handling beyond what is necessary to establish the artwork’s nature, characteristics and condition.

Please retain and reuse the original packaging where reasonably possible because it is designed to protect the artwork. If it is unavailable, you must package the artwork safely and to an equivalent standard. The absence of original packaging does not by itself cancel your statutory right to return, but you may be responsible for damage caused by inadequate return packaging.

10. Refunds after a change-of-mind cancellation

If you validly cancel, we will refund the amount paid for the artwork and the cost of our least expensive standard delivery option. Because standard shipping is normally included in Aperio’s displayed price, this will usually mean refunding the full displayed price. We do not have to refund an additional amount paid for an upgraded delivery method.

We will make the refund within the period required by applicable law. We may withhold the refund until we receive the returned artwork or you provide satisfactory evidence that it has been handed to the carrier for return, whichever occurs first. Before dispatch, we may ask you to provide photographs showing the condition of the artwork and its packaging. You must use an appropriately tracked and insured return service and provide the tracking information to Aperio. We reserve the right to deduct or recover any reduction in value caused by handling or damage for which you are responsible.

11. Faulty, damaged or misdescribed artworks

Irish consumer law requires goods to match their description, be of the agreed quality and be fit for their normal and any agreed purpose. Your statutory remedies may include repair, replacement, a proportionate price reduction or termination of the contract and a refund, depending on the circumstances. A repair or replacement may not be possible for a unique artwork; where it is impossible or disproportionate, another remedy required by law will apply.

If an artwork arrives damaged, faulty or materially different from its description, please contact Aperio as soon as possible. Where reasonably possible, provide photographs of the artwork, shipping labels and packaging and retain all packaging until we have provided instructions.

We are not responsible for deterioration caused after delivery by accidental damage, mishandling, unsuitable hanging or framing, cleaning, direct sunlight, excessive humidity, heat, damp, pests, or failure to follow care instructions.

12. Authenticity, editions and certificates

Where stated on the artwork page, an artwork will be signed and/or supplied with a Certificate of Authenticity. Limited-edition works will carry the edition information described on the product page. A certificate may be sent separately for security and provenance purposes.

The stated edition size is fixed and applies across all sizes, formats and presentations of the artwork. For example, an edition of 10 is limited to ten numbered prints in total. Once the edition is complete, it is permanently closed and no additional numbered prints may be produced. Artist’s proofs are identified and sold separately.

13. Copyright and permitted use

Buying an artwork transfers ownership of the physical artwork only. Copyright and all other intellectual-property rights remain with the artist or other rights holder. The owner may display, exhibit, lend, donate or resell the physical artwork, including through a museum, gallery or public collection. Ownership does not include the right to reproduce, publish, distribute, merchandise, commercially exploit or create derivative works from the artwork without the rights holder’s permission, except where otherwise permitted by law.

14. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your mandatory rights under consumer law.

Aperio is not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses where you purchased as a consumer. We are not responsible for delay or failure caused by events outside our reasonable control, but we will contact you, take reasonable steps to reduce the effect and respect any cancellation or refund right that applies.

15. Complaints

If you have a problem with an order, please contact Aperio using the details in section 1 and quote your order number. We will try to resolve the matter fairly and within a reasonable time. This does not affect your statutory consumer rights.

16. Governing law

These terms and each contract between you and Aperio are governed by Irish law, subject to any mandatory consumer protections that apply.

17. General

If a court or competent authority finds part of these terms unlawful or unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right does not waive it.

We may update these terms from time to time. The terms in force when your order is accepted will govern that purchase. Changes will not apply retrospectively to an existing contract.

You may not transfer your rights under the contract without our consent, except where the law allows. We may transfer our rights or obligations only where this does not reduce your rights or protections.

Order Cancellation Form

Complete and return this form only if you wish to cancel the contract. You may instead send any other clear written statement containing the same information.
