Open Call Terms & Conditions

These Terms & Conditions apply to artists submitting work to Aperio Gallery open calls.

1. Eligibility and Submission

Artists must be aged 18 or over and must be the creator of, and have the right to submit, the artwork entered.

All information provided must be accurate and complete. Submitted artwork must be available for sale at the price stated at the time of submission.

There is no fee to submit work to an open call. Submission does not guarantee selection.

2. Selection

Artwork is selected at the curatorial discretion of Aperio Gallery.

Selected artists will be notified by email and given a deadline to accept their place and pay the applicable exhibition fee.

Selection applies only to the artwork(s) specified by Aperio Gallery.

Aperio Gallery does not guarantee any particular level of exposure, enquiries or sales as a result of participation in an exhibition.

3. Exhibition Fee and Payment

There is no charge unless work is selected.

The exhibition fee and payment deadline will be stated in the artist's selection email. Payment of the exhibition fee confirms the artist's participation in the exhibition.

If payment is not received by the stated deadline, Aperio Gallery may withdraw the offer of a place.

4. Artist Withdrawal, Cancellation and Refunds

Once the exhibition fee has been paid and participation confirmed, the exhibition fee is non-refundable if the artist subsequently withdraws, fails to participate or the selected artwork becomes unavailable.

If Aperio Gallery cancels the exhibition, exhibition fees paid by participating artists will be refunded.

Where an exhibition has to be postponed or materially altered because of circumstances outside Aperio Gallery's reasonable control, participating artists will be informed of the arrangements.

5. Selected Artwork and Pricing

Selected artwork must remain available for sale for the duration of the exhibition unless otherwise agreed with Aperio Gallery.

The selling price supplied in the submission must include Aperio Gallery's 20% commission but, for open-call exhibitions, does not include shipping unless expressly stated otherwise.

The artist must notify Aperio Gallery immediately if a selected artwork becomes unavailable before or during the exhibition.

6. Sales, Shipping and Fulfilment

Shipping for open-call exhibition artwork will be quoted separately according to the artwork and its destination.

When requested by Aperio Gallery, the artist must obtain and provide an accurate quotation for appropriate tracked and adequately insured delivery.

The artist is responsible for:

  • professionally and securely packaging the artwork;
  • obtaining an appropriate shipping quotation;
  • selecting an appropriate tracked and adequately insured carrier;
  • arranging and booking the shipment;
  • paying the carrier;
  • dispatching the artwork within the agreed timeframe; and
  • providing Aperio Gallery with proof of dispatch and tracking information.

Any shipping amount charged to the buyer is separate from the artwork sale price and does not form part of the amount on which Aperio Gallery's commission is calculated.

The artist is responsible for any additional cost arising from inaccurate dimensions, weight or shipping information supplied by the artist, inadequate packaging or failure to comply with agreed shipping requirements.

7. Buyer Contact and Sales Through Aperio

Aperio Gallery is the buyer's sole point of contact.

Artists must not communicate directly with buyers or prospective buyers introduced through Aperio Gallery, accept payment from them, negotiate a sale or delivery directly with them, or use buyer information for any purpose other than order fulfilment expressly authorised by Aperio Gallery.

All enquiries, sales, cancellations, returns, refunds and complaints relating to artwork offered through Aperio Gallery must be handled through Aperio Gallery.

Where limited buyer information is provided to an artist for the purpose of fulfilling an order, it may only be used for that purpose and must be handled in accordance with the Aperio Gallery Artist Terms of Business and applicable data-protection requirements.

Artists must not use contact with a buyer introduced through Aperio Gallery to arrange a private sale or otherwise circumvent the gallery. Where Aperio has materially introduced or facilitated a sale, the applicable Aperio commission remains payable.

Your existing Artist Terms already provide the more detailed rules on collector data, including limiting its use to fulfilment, security, deletion and prohibiting its use for the artist's own marketing.

8. Returns, Cancellations and Problems with Delivery

Sales are subject to Aperio Gallery's applicable Buyer Terms of Sale, Shipping Policy and Returns Policy and to any mandatory consumer rights.

Aperio Gallery will handle communications with buyers concerning cancellations, returns, damage, complaints and refunds.

The artist must cooperate promptly with Aperio Gallery in resolving any issue relating to an artwork sold through the exhibition.

Where a cost or refund arises because the artist supplied materially inaccurate information, failed to dispatch the artwork as agreed, supplied the incorrect artwork, or inadequately packaged the artwork, the artist will be responsible for the resulting reasonable costs in accordance with the Artist Terms of Business.

9. Copyright, Images and Promotion

Copyright in submitted artwork remains with the artist or other lawful copyright holder.

By submitting work, the artist grants Aperio Gallery permission to reproduce the submitted artwork images and information for purposes connected with the open call, exhibition and its promotion, including the Aperio Gallery website, social media, email marketing, advertising, editorial and press activity.

The artist confirms that they hold the necessary rights and permissions relating to the artwork and material submitted and will provide evidence of any necessary permissions or releases if reasonably requested.

10. Accuracy and Compliance

Aperio Gallery may decline or remove artwork where information supplied is materially inaccurate or misleading, the artwork differs materially from the work submitted, or the artist fails to comply with these Terms.

11. Artist Terms of Business

Artists whose work is selected and offered for sale through Aperio Gallery are also subject to the Aperio Gallery Artist Terms of Business.

Those terms govern the wider commercial relationship between Aperio Gallery and the artist, including commission, payment to artists, fulfilment, insurance, returns, copyright, collector information and other responsibilities arising from the promotion and sale of artwork. Your existing Terms already contain those provisions in considerable detail.

Where these Open Call Terms contain specific provisions relating to an open-call exhibition, including the exhibition fee and separate quotation of shipping costs, these Open Call Terms apply in addition to and, in relation to those specific matters, take precedence over the Artist Terms of Business.

12. Acceptance of Terms

By submitting work to an Aperio Gallery open call, the artist confirms that they have read and agree to these Open Call Terms & Conditions.

If selected, payment of the exhibition fee constitutes acceptance of these Open Call Terms & Conditions and the Aperio Gallery Artist Terms of Business.
