This Returns Policy explains how to cancel an online purchase, return an artwork or report an artwork that arrived damaged, faulty or materially different from its description. It forms part of Aperio's Buyer Terms of Sale.
1. Contact Aperio before returning an artwork
All cancellations, return requests, damage reports and refund queries must be made through Aperio. Do not return an artwork directly to the artist or to the address from which it was dispatched unless Aperio has provided that address in writing as part of the return instructions.
Email info@aperiogallery.com and include your order number and artwork title. For cancellation without giving a reason, you may use the Order Cancellation Form in the Buyer Terms of Sale, but you do not have to use that form.
2. Fourteen-day change-of-mind cancellation
If you are a consumer in Ireland, the European Union or another country whose mandatory law provides an equivalent right, you may cancel most online purchases without giving a reason within 14 days after you, or a person nominated by you other than the carrier, receives the artwork.
You must tell Aperio that you are cancelling before the 14-day period ends. After notifying us, you must return the artwork within a further 14 days in accordance with our return instructions.
3. Change-of-mind return costs and insurance
When you cancel simply because you changed your mind, you are responsible for arranging and paying for tracked and appropriately insured return delivery. Where an artwork cannot normally be returned by post, an estimate of the direct return cost will be provided on the artwork page before purchase.
Before dispatch, we may ask you to provide photographs showing the condition of the artwork and its packaging. You should also provide the return tracking details and, if requested, evidence that the artwork has been handed to the carrier.
4. International returns and customs documentation
Every international return must be accurately declared to the carrier and customs authorities as returned goods and not as a new sale or gift. The person booking the return is responsible for completing the carrier’s required customs information and identifying the shipment as the return of the original artwork. The original order number, invoice and shipment details should be included where requested.
You must follow the return instructions and use any customs documents generated by the carrier. You must not alter the description, reason for return or customs value. Aperio and the artist will not be responsible for customs duties, import taxes, clearance charges or penalties caused by inaccurate, incomplete or altered information supplied by you, or by your failure to identify the shipment as returned goods.
Customs duties, import taxes and clearance fees paid in connection with the original delivery are not collected by Aperio and are not refundable by Aperio. If customs charges are imposed on a correctly declared return, contact Aperio before paying the charge or allowing the carrier to return the shipment so that the matter and any available returned-goods relief can be investigated.
5. Packing a change-of-mind return
Please retain and reuse the original packaging where reasonably possible because it is designed to protect the artwork. If it is unavailable, you must package the artwork safely and to an equivalent standard and comply with the packaging requirements of the carrier and insurer selected for the return.
The absence of original packaging does not by itself remove your statutory cancellation right. You may, however, be responsible for damage or loss in value caused by inadequate packaging or handling beyond what is reasonably necessary to establish the artwork's nature, characteristics and condition.
6. Refunds following change-of-mind cancellation
If you validly cancel, we will refund the amount paid for the artwork and the cost of our least expensive standard delivery option. Because standard shipping is normally included in Aperio's displayed price, this will usually mean refunding the full displayed price. Any additional amount paid for upgraded delivery is not refundable.
We will make the refund within the period required by applicable law. We may withhold it until the returned artwork is received or you provide satisfactory evidence that it has been handed to the carrier for return, whichever occurs first. The refund will be made using the original payment method unless you expressly agree otherwise.
Aperio may deduct or recover any reduction in value caused by handling or damage for which you are responsible.
7. Damaged, faulty or misdescribed artworks
If an artwork arrives damaged, faulty, incomplete or materially different from its description, contact Aperio as soon as possible. Where reasonably possible, photograph the outer packaging before opening it, the shipping labels, the internal packaging, the complete artwork and clear details of any damage. Please retain the artwork and all packaging until Aperio has provided instructions. This evidence assists with assessing the claim and pursuing the carrier or insurer.
Do not return the artwork until Aperio has provided instructions. Where a return is required because the artwork arrived faulty or damaged or did not conform to the contract, Aperio will arrange an appropriately insured return or collection at no cost to you.
Depending on the circumstances and applicable consumer law, the available remedy may include repair, replacement, a proportionate price reduction or cancellation and refund. Repair or replacement may not be possible for a unique artwork.
8. Inspection of returned artworks
Returned artworks will be inspected promptly after receipt. If a change-of-mind return shows handling beyond what is reasonably necessary, inadequate packaging, or damage occurring after delivery to you, Aperio may apply the reduction in value permitted by law. This does not apply to damage or non-conformity that existed when the artwork was delivered to you.
